Terms of Service

This website is operated by Broody (“we”, “us”, “our”). By visiting our site and/or purchasing from us you agree to be bound by these Terms & Conditions (“Terms”), our Privacy Policy, and our Shipping & Returns Policy (together, the “Policies”).

We may update these Terms at any time by posting a new version. Continued use of the site constitutes acceptance.

1) Online Store Terms

You confirm you are of the age of majority in your place of residence (or have parental consent). You may not use our Services for any unlawful purpose.

2) General Conditions

We may refuse service to anyone at any time. Non-card data may transmit unencrypted over networks; card data is always encrypted. You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service without our written permission.

3) Accuracy of Information

Site content may contain typographical errors or omissions. We may correct errors and change or update information at any time.

4) Products & Availability

Some products may be available exclusively online and in limited quantities. We may limit sales to any person, region or jurisdiction and discontinue products at any time. Colors and details shown on your device may vary.

All sizes, dimensions, weights and other measurements provided are approximate. Plush toys are measured from the top of the head to the bottom of the feet when extended. As plush toys are soft-stuffed, actual size may vary slightly (typically within ±2 inches / 5 cm) depending on measurement method or stuffing. Such variations are not considered defects.

5) Pricing, Taxes & Duties

Prices may change without notice. Prices are shown exclusive/inclusive of taxes where indicated at checkout. You are responsible for any import duties, taxes, or fees applicable at destination if shown/explained at checkout.

6) Orders, Billing & Account Info

We may refuse or cancel orders (e.g., suspected fraud, incorrect pricing). We may limit quantities per person/account/address. You agree to provide and promptly update accurate information (email, address, payment method).

7) Shipping & Delivery

Order processing and delivery timeframes are set out in our Shipping & Returns Policy (including dispatch within 1–2 business days and typical delivery estimates to metro areas).

Express Shipping: We offer an optional express shipping service with shorter estimated delivery times. Express shipping is charged separately and is non-refundable once your order has been dispatched. Delivery times for express shipping are always estimates from dispatch and are not guaranteed, as they may be affected by customs clearance, courier delays, or other factors beyond our control.

Timeframes are always counted from the moment of dispatch, exclude customs/courier disruptions, and may be longer for remote areas.

Address changes: once an order is confirmed, we cannot change the shipping address or redirect parcels, please check details carefully at checkout.

Proof of delivery: Once the carrier marks an order as delivered (including but not limited to delivery scans, GPS data, photos, or signed confirmation), the order is considered fulfilled and completed. We are not responsible for parcels lost, stolen, or damaged after the carrier has recorded delivery at the shipping address provided.

8) Returns, Withdrawal & Refunds

Our detailed rules are outlined in the Shipping & Returns Policy, which forms part of these Terms. Key points for clarity:

  • Return period: Returns are accepted within 14 days of delivery for all customers worldwide (in line with the EU Consumer Rights Directive).

  • Refunds: We will refund the product price and, where required by law, the cost of the cheapest standard delivery option we offered. If you selected Express Shipping, that fee is non-refundable once your order has been dispatched.

  • Return shipping: For “change-of-mind” returns, the cost of return shipping is the customer’s responsibility, as stated in our Policy.

  • Defective or incorrect items: If an item arrives defective, damaged, or not as described, we will cover the return costs or provide a replacement or refund without requiring a return, depending on the case.

How to return: You may use any courier at your expense for change-of-mind returns, but you must provide a valid, trackable number. Returns without tracking may be rejected.

Refund timing: Refunds are issued to the original payment method after we receive and inspect returned items, or once we confirm a defect.

Refusing return shipping: If you decline to pay return shipping for a change-of-mind return, we cannot process the return or refund.

Non-delivery/delay: If delivery exceeds the stated timeframe, we will provide an update and a reasonable additional period for delivery. If still undelivered after that period, you may cancel for a full refund of the product price and standard shipping (where applicable). Express shipping fees are excluded from such refunds once an order has been dispatched.

Note: Offering free outbound shipping does not mean we cover return shipping for change-of-mind returns.

9) Risk of Loss & Title

Title to products passes to you once we have received full payment. Risk of loss or damage transfers to you upon delivery to the shipping address provided (or upon the first attempted delivery where signature or collection is required).

Where the delivery carrier records delivery (through system scans, GPS data, photo, or signature), the order is deemed successfully delivered. From that point onward, responsibility for the parcel rests with you. We are not liable for loss, theft, or damage occurring after the carrier has recorded delivery.

10) Promotions & Coupons

Promotional offers are subject to their specific terms and may be modified or withdrawn at any time.

11) Shipping Protection: Broody™ Shipping Insurance

If you add our Broody™ Shipping Insurance protection at checkout, your order is covered against loss or damage in transit:

  • Loss: If the delivery carrier does not deliver your parcel or marks it as delivered but you are unable to locate it, we will replace or refund your order one time.

  • Exclusions: The plan does not cover delays due to customs or courier disruptions, change-of-mind returns, or repeated claims on multiple orders.

Claims must be made within 7 days of the carrier’s recorded delivery date. Resolution will be either a replacement or refund at our discretion.

Note: damaged or defective items are always covered by our standard consumer rights policies and do not require the purchase of this protection.

12) Third-Party Tools & Links

We may provide access to third-party tools and links “as is”. We are not responsible for third-party websites, content, or services.

13) User Content & Feedback

If you send ideas, comments, or materials, you grant us a non-exclusive, royalty-free license to use them without obligation (including confidentiality, payment, or response). You are responsible for submissions and must not violate others’ rights or applicable law.

14) Prohibited Uses

You may not use the site to: violate laws; infringe IP rights; harass/abuse; submit misleading info; upload malware; collect data without consent; or engage in spam/scraping/hacking. We may suspend/terminate access for violations.

15) Payments, Chargebacks & PayPal Disputes

By placing an order you authorize charges to your payment method. If you open a chargeback or PayPal dispute, we may provide evidence including tracking, delivery scans, and our Policies. Where tracking shows in-transit or delivered within policy timeframes, refunds may be declined.

16) Disclaimer; Limitation of Liability

The Service and all products are provided “as is” and “as available” without warranties to the fullest extent permitted by law. We are not liable for indirect or consequential damages (including lost profits or data). Nothing excludes liability where it cannot be excluded by law.

17) Indemnification

You agree to indemnify and hold harmless Broody and our affiliates, officers, employees, and partners from claims arising from your breach of these Terms or applicable law.

18) Severability

If any provision is unlawful or unenforceable, the remainder remains in effect.

19)Termination

These Terms remain in effect unless terminated. If you fail to comply, we may suspend/terminate access immediately.

20) Governing Law & Venue

These Terms are governed by the laws of Portugal and applicable EU consumer law. Courts of Porto, Portugal shall have non-exclusive jurisdiction, without prejudice to any mandatory consumer venue rights you may have in your country of residence.

21) Alternative Dispute Resolution (ADR) – EU Notice

We are open to resolving disputes amicably. Note: the EU’s Online Dispute Resolution (ODR) platform was discontinued on 20 July 2025; references/links are no longer required. You may seek assistance via your national consumer ADR body.
